Property Release?

Unread post by harvey »

This question is specific to the UK (Scotland in particular).

Last year I took some photographs in a large walled private garden with permission of the gardener. Most pictures include views of the house which would be identifiable by a local.

Do I need a property release to use the photographs for any commercial use?

I am asking the question in general but specifically I'm only thinking of putting the photographs forward for consideration for inclusion in a charity calendar.

Sometimes forgiveness is easier to get than permission. LOL

If you were inside the walled garden yes. You should ask. If the view could be taken from a road, even if you asked at the time, there is no need to make a formal request - if you can see it, you can publish it.
